DMCA Compliance Notice

MightyMerchant’s DMCA (Digital Millennium Copyright Act) Compliance StatementMightyMerchant recognizes and makes every effort to comply with the Digital Millennium Copyright Act (DMCA). The DMCA, which was passed in 1998, protects Internet Service Providers from absolute liability in copyright infringement cases.

Historically, copyright laws designate "absolute liability" for violation of copyright rights, including reproduction, distribution, modification, public performance and public display of copyrighted material.

The DMCA provides relief from monetary damages for certain practices. For example, an Internet webpage could contain copyrighted images used without permission of the copyright holder. The DMCA keeps the Internet Service Provider (ISP) from being held liable in such a situation under the regulations outlined in the Online Copyright Infringement Liability Limitation Act, available at the U.S. Copyright Office Website: www.loc.gov/copyright.

The DMCA limits ISPs from liability for copyright infringement, soley for transmitting information across the Internet. However, ISPs are expected to remove material that appears to constitute copyright infringement.

It is MightyMerchant’s policy to respond to notices of alleged copyright infringement in compliance with the DMCA. This might include removing or disabling access to material, alleged to be related to copyright infringement.

In the event of a copyright infringement claim, MightyMerchant, in compliance with the DMCA, will make a good faith effort to contact the site owner of the website that contains the material so that they may have the opportunity to make a counter-notification as specified in the DMCA. If no counter-claim is received within 14 days of notification, or MightyMerchant believes the claim to be reasonable, MightyMerchant will remove the materials referenced in the claim.

To file a copyright infringement notification with MightyMerchant, a written communication by mail or fax must be received which includes the following:

A link to the page containing copyrighted work that has been infringed and a description of the nature of the infringement.

Address and telephone number of the person making the copyright infringement claim.

Inclusion of the following statement:
"I have a good faith belief that use of the copyright materials described above on the allegedly infringing web pages is not authorized by the copyright owner, its agent, or the law. I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

MightyMerchant will notify the site owner within three business days of receipt of the copyright infringement claim.

The DMCA provides for counter notification if a site owner feels he or she is being wrongly accused of copyright infringement. A written counter-notification letter by fax or regular mail must be sent, including the information below:

Identification of URLs or material that has been removed or disabled by MightyMerchant.

Name, address, telephone number, email address and a statement consenting to the jurisdiction of the Federal District Court for the judicial district in which your address is located.

Include the following statement:
"I swear, under penalty of perjury, that I have a good faith belief that the item identified above was removed or disabled as a result of a mistake or misidentification and is not infringing on copyright."

MightyMerchant will notify the individual or agent who filed the initial copyright claim about the counter-notification within 14 business days of receipt of the counter-notification, and will take action to restore any material that has been removed, if such action seems reasonable. In cases where the parties cannot come to agreement on the copyright infringement claim, MightyMerchant will remove or restore material as deemed appropriate by the courts.

Domain Expiration Policy

This is an important notice from eNom regarding recent changes mandated by the Internet Corporation for Assigned Names & Numbers (ICANN). In December of 2012, ICANN approved and adopted the terms set forth in the Expired Registration Recovery Process (ERRP). The ERRP terms are being incorporated into the eNom Reseller Agreement, effective August 1st, 2013.You must come into compliance with the ERRP, including the following, by August 31st, 2013:If you are not utilizing eNom for renewal notifications you need to do the following:a. Prior to expiration, you must notify the registered name holder of the expiration at least two times. Once approximately one month prior to expiration (26-35 days prior to expiration is considered compliant) and once approximately one week prior to expiration (4-10 days prior to expiration is considered compliant).b. Within five days after the expiration of the registration, you must transmit at least one additional expiration notice to the registered name holder that includes instructions for renewing the domain registration.c. Notifications of expiration may be presented in one or more languages, but must be provided in the language of the registration agreement and must be communicated in a manner, such as by email, that does not require affirmative action to receive the notificationd. All e-mail communications must be stored for 3 years for auditing purposes.If you would like eNom to send renewal notifications on your behalf, click here.For registrations deleted within eight days of expiration, beginning at the time of expiration through deletion, you must permit the registered name holder to renew the expired registration. For registrations deleted eight or more days after expiration, beginning at the time of expiration through at least the last eight consecutive days after expiration that the registration is renewable by the registered name holder, you must permit the registered name holder to renew the expired registration.
You must permit the registered name holder to redeem a deleted registration during the redemption grace period, if a redemption grace period is offered by the respective registry.
You must make the renewal fees, post-expiration renewal fees (if different), and the redemption/restore fees reasonably available to registered name holders and prospective registered name holders at the time of registration of a gTLD (at a minimum, these fees must be included on your website and a link to these fees must be included in your registration agreements).
You must describe on your website (if used) the methods used to deliver pre- and post-expiration notifications (this description should generally include communications channels/media that will be used and identification of the point of contact to which the notices will be transmitted, and your registration agreements must include either a similar description of your notification methods or a link to the applicable page(s) on your website where this information is available).

Domain Registrant Benefits and Responsibilities

Your domain name registration and any privacy/proxy services you may use in conjunction with it must be subject to a Registration Agreement with an ICANN Accredited Registrar.  You are entitled to review this Registration Agreement at any time, and download a copy for your records.  You are entitled to accurate and accessible information about:  The identity of your ICANN Accredited Registrar;  The identity of any proxy or privacy service provider affiliated with your Registrar;  Your Registrar's terms and conditions, including pricing information, applicable to domain name registrations;  The terms and conditions, including pricing information, applicable to any privacy services offered by your Registrar;  The customer support services offered by your Registrar and the privacy services provider, and how to access them;  How to raise concerns and resolve disputes with your Registrar and any privacy services offered by them; and Instructions that explain your Registrar's processes for registering, managing, transferring, renewing, and restoring your domain name registrations, including through any proxy or privacy services made available by your Registrar.  You shall not be subject to false advertising or deceptive practices by your Registrar or though any proxy or privacy services made available by your Registrar. This includes deceptive notices, hidden fees, and any practices that are illegal under the consumer protection law of your residence.
Domain Name Registrants' Responsibilities:  You must comply with the terms and conditions posted by your Registrar, including applicable policies from your Registrar, the Registry and ICANN.  You must review your Registrar's current Registration Agreement, along with any updates. You will assume sole responsibility for the registration and use of your domain name.  You must provide accurate information for publication in directories such as WHOIS, and promptly update this to reflect any changes.  You must respond to inquiries from your Registrar within fifteen (15) days, and keep your Registrar account data current.If you choose to have your domain name registration renew automatically, you must also keep your payment information current.

Server Access Assistance

We have put together the following guidelines related to server access. Our top priority is security. We do our best to balance security considerations with the needs of our customers to update their sites and download/upload data.
Site Updates - Virtually all site changes to a MightyMerchant site can be accomplished through the MightyMerchant site manager. If you have not used the MightyMerchant site manager or don't remember how to access your site manager, let us know, and we can help get you going.
FTP Access - Security is our top priority. As our webservers handle several million dollars a month in transactions and we are required to conform to industry guidelines for security, we rarely provide ftp access to customers or third party vendors. Typically there is very little in the way of ongoing changes that requires ftp access. If you feel there are some site changes you are unable to make, let us know what those are, and we will do our best to help.
Uploading and Downloading Files - If you need to upload or download files, please give us the details of your specific needs and we are happy to help. Because our sites are database-driven, there is typically very little need to access the files on the web server. Most of what you need should be accessible via the database.
Third Party Marketing Firms- We are glad to help our customers and their marketing teams accomplish what they need. Often, small updates or placement of verification codes, redirect files, or landing pages, can be done at little or no charge. If a request will require more significant time or the installation of advanced functionality, we will let you know the cost before doing any work.
